We aim for transparency in our processing of your personal data. It is important to us that you take the time to read this privacy policy, which will inform you about how we handle your personal information. At JKS, we receive information about applicants, temporary workers, permanent employees, and business partners, so we have different privacy policies. The privacy policy you are currently reading applies to applicants, current and former temporary workers, as well as business partners (customers and suppliers).

Purpose
JKS only collects necessary personal information for specific purposes, which you can read more about below, and we delete this information when there is no longer a legitimate purpose for processing it. You can also read more about this.

When you create a CV or apply for a job
Purpose

We collect and process your information to perform our tasks, including job placement, temporary services, recruitment, and selection. More specifically, we process your personal information to:

  1. Send you offers and/or information about our services and other activities, and better coordinate these with your requirements and qualifications. These tasks are carried out by our employees.
  2. Assess your suitability or availability for job placements in permanent or temporary positions or tasks, where test results, reference checks, etc., may also be used.
  3. Process data for our customers in relation to pre-employment screening.

What personal data do we collect?
We process the information you provide through the website and the information you submit in your CV and possibly other documents. This primarily includes the following information:

  • Name and address details
  • Email address and other contact information
  • Date of birth
  • Employment status
  • Curriculum vitae (CV) - information about education, internships, work experience, language skills
  • Information about courses and training
  • Driver's license and type
  • Any references

In most cases, all information comes from you. If you have provided references, we may choose to contact these references. The information we obtain from references pertains to your job function and consists solely of general personal information.

Disclosure of your information
When matching your preferences and qualifications with available jobs, your information will be disclosed to the company that has a relevant job opening. The respective company will process your personal information in connection with the position. If you are applying for jobs in the hotel, restaurant, and catering industry, we may choose to disclose your information to Assistance HR Partners A/S, which is 100% owned by JKS. We do this to enhance your job opportunities, as Assistance HR Partners A/S specializes in this industry.

Legal basis
The legal basis for processing and disclosing your personal information is the General Data Protection Regulation Article 6, 1, f), also known as the legitimate interest rule. The legitimate interest we pursue is the desire to match the right temporary workers with the right jobs. The legal basis for obtaining references is also Article 6, 1, f), and the interest we pursue is to confirm the information we received in the recruitment process.

Retention period
Your personal information is stored for as long as it is relevant, meaning as long as there are opportunities for relevant jobs. You can request the deletion of your personal information at any time, and in many cases, you may be able to do so yourself.

When you become affiliated with JKS as a temporary worker
You will receive an affiliation agreement that needs to be signed:

  • When we have a vacant temporary position that matches your preferences and qualifications or
  • If we assess that you can be offered a temporary position relatively quickly.

This agreement is part of the overall employment agreement you will receive when you are offered a specific temporary position.

Purposes
The purpose of collecting additional information is to manage your employment relationship, including paying your wages when you are on the job, and continuously offering you temporary positions.

What personal information do we collect about you?
In addition to the information you provided when you uploaded your CV, etc., we collect and process additional information as necessary and relevant. This primarily includes the following:

  • CPR number
  • Bank details
  • Tax information
  • Information related to the specific temporary position, including workplace, start and end dates, meeting times, wages, collective agreements, pensions
  • Any certificates, authorizations, etc.
  • Vaccinations
  • Work permit, nationality
  • Sick leave
  • Vacation and other leave
  • Leave, including pregnancy, maternity, and paternity leave
  • A-kasse (unemployment fund) (for G-days)
  • Union affiliations (only in cases where it is necessary to establish, assert, or defend a legal claim, as per the General Data Protection Regulation Article 6, 1, f) and Article 9, 2, f))
  • Work-related injuries
  • Employment law sanctions, such as warnings, reprimands, terminations, or dismissals

We receive some of the information from you. Regarding the information related to the specific temporary position, we receive this information from the company where you are employed. We also receive information from public authorities, including the tax authorities (SKAT).

If you become ill while on the job, you must report your sick leave by phone - you will be informed of this in the affiliation agreement and job order. We record the call because we want to document your sick leave. The reason is that we can only pay sick pay when we have received a sick leave report.

Disclosure of your information
We disclose certain information to the companies where you work. This information includes your name, JKS payroll number, position, residence (city only), any sick leave, and other acute absences. During your employment, the customer company will process this information. Furthermore, we disclose salary information to the tax authorities (SKAT) and pension companies, if applicable. We may also disclose relevant information to:

  • ATP (Arbejdsmarkedets Tillægspension)
  • The Danish Occupational Injury Board (Arbejdsskadestyrelsen)
  • The Holiday Fund (Feriekonto)
  • Municipalities regarding unemployment benefit refunds
  • DA-Barsel and/or Barsel.dk
  • Employers' Training Contribution
  • Our external auditor
  • Our external legal advisor, including the Confederation of Danish Industry (DI)

Legal basis
The legal basis for processing your personal information is the General Data Protection Regulation Article 6, 1, b) and Article 6, 1, c), as well as the Danish Data Protection Act § 11, paragraph 2, no. 1). The legal basis for processing information related to any work-related injuries is the General Data Protection Regulation Article 6, 1, c) and 9, 2, b). Recording of phone calls is done in accordance with the Danish Data Protection Act Article 6, 1, f), where the legitimate interest we pursue is the ability to assert and defend any legal claims.

Retention period
We retain your information for as long as you have an affiliation agreement with JKS. However, telephone sick leave reports are deleted after one year. If you have not worked for JKS for an extended period, we will contact you to inquire if you still wish to remain affiliated with JKS. If we do not hear from you or if you no longer wish to be affiliated with JKS, we will mark your information as "terminated." You can see below how long we retain your information.

When you have worked and are no longer affiliated with JKS
When your affiliation with JKS ends, we retain your information for 5 years. JKS also retains information covered by the Danish Bookkeeping Act and tax legislation in accordance with these rules. If there is a valid reason to retain information for a longer period, this may be done, such as in the case of work-related injuries.

Purposes
The purpose of retaining your information is, among other things, to assess and respond to any subsequent legal claims and comply with relevant legislation.

Legal basis
The legal basis for retaining your personal information is the General Data Protection Regulation Article 6, 1, c) and 6, 1, f). The legitimate interest we pursue is that a potential legal claim can be determined, asserted, or defended. The retention of work-related injury cases is done under the General Data Protection Regulation Article 6, 1, c) and f) and Article 9, 2, b) and f).

Personal information about customers, suppliers, and other business partners
We process personal information about you if you work for one of our business partners and are the contact person for JKS.

Purposes
We process your personal information to be able to:

  • Provide offers and/or provide information about our services and other activities.
  • Request and review offers and information about services and products for JKS.
  • Maintain a business relationship.
  • Enter into and manage orders.

What personal information do we process?
We primarily process your name, email address, phone number, position, and company.

Disclosure
JKS may disclose personal information from business partners if necessary to fulfill the purpose of job placement/task. This information can be disclosed to other JKS entities, applicants or candidates, business partners, and subcontractors (e.g., data processors) who provide services on behalf of JKS.

Retention period
We process your information for as long as it is relevant - that is, as long as there is a business relationship and for a period thereafter.

Legal basis
The legal basis for processing your personal information is the General Data Protection Regulation Article 6, 1, b) and 6, 1, f). The legitimate interest we pursue is the ability to enter into and maintain a dialogue and contact with our business partners and collaborators.

Security
We place a strong focus on security when processing personal information and have implemented physical, administrative, organizational, and technical security measures to protect your personal information from being destroyed, lost/changed, or accessed or disclosed without authorization.

JKS has adopted internal rules on information security, which contain instructions and measures that protect your personal information from unauthorized disclosure and from being accessed or disclosed by unauthorized persons. We have established procedures for granting access rights to our employees who process personal data. We monitor their actual access through logging and supervision of the systems where it is required.

To prevent data loss, JKS regularly backs up our data sets.

In the event of a security breach resulting in a high risk to you, such as discrimination, identity theft, financial loss, loss of reputation, or other significant inconvenience, JKS will notify you of the security breach as soon as possible.

Our security procedures are regularly reviewed in light of the latest technological developments.

In addition to internal JKS systems, we use external IT service providers. We have data processing agreements with all relevant external providers.

Your rights
When we process your personal information, you have several rights:

Right to access your personal information:
You have the right to access the personal information we process about you.

Right to rectification:
You have the right to have inaccurate personal information about you corrected.

Right to erasure:
In certain cases, you have the right to have your personal information deleted.

Right to restriction of processing:
In certain cases, you have the right to have the processing of your personal information restricted to storage.

Right to withdraw consent:
If you have given consent for the processing of one or more of your personal information, you can withdraw your consent at any time under the personal data regulations. Unless the company has another lawful basis for processing, we can no longer process the information in question.

Right to object:
In certain cases, you have the right to object to our processing of your personal information.

Right to data portability:
In certain cases, you have the right to receive your personal information in a structured, commonly used, and machine-readable format and to have these personal data transmitted from one data controller to another without hindrance.
